User / Customer / Buyer / Visitor / Subscriber / Member Information
The natural/legal person who accesses, visits, subscribes/becomes a member of the website, receives services, or makes purchases.
In the implementation and interpretation of this agreement, the terms below shall have the meanings set forth opposite them.
"Service Provider", "Seller": "Tanti Jewellery"
"User": The "Visitor" accessing and browsing our website and mobile applications, or the "Subscriber" / "Member", "Customer" and "Buyer" who registers for, benefits from, and makes purchases for any of the offered Product Sales / Services.
Parties : The Service Provider and the User
Website/Application: The [www.tantijewellery](https://www.tantijewellery) website belonging to the Service Provider, and the iOS and Android applications belonging to the Tanti Jewellery brand.
Services: All services offered by us through the [www.tantijewellery](https://www.tantijewellery) website and our brand's iOS and Android mobile applications, including product sales, training, events, and the like.

Subscription (Membership) Agreement: This Subscription (Membership) Agreement concluded between the Service Provider / Seller and the User.
The purpose of this agreement is to inform the visitors, users, subscribers, members, customers, and buyers of the [www.tantijewellery.com](https://www.tantijewellery.com) website about their rights and obligations under the Terms of Use and our Policies.
Terms of Use contain all provisions and conditions applicable to the [www.tantijewellery.com](https://www.tantijewellery.com) website. In case of violation of these conditions, the Service Provider / Seller may suspend or cancel the User / Buyer's accounts.
The User who visits the website, subscribes/becomes a member, or becomes a customer/buyer by making a purchase and payment; acknowledges, declares, and undertakes that they have read the entirety of the Subscription (Membership) Agreement, fully understood its content, and approved all its provisions in accordance with the Disclosure Texts (Privacy & Personal Data Protection Policy – Cookie Policy), Terms of Use, Preliminary Information Form and Distance Sales Agreement.
Article 2 – Subscription / Membership / User Account and Account Security
2.1 Account Registration: The User shall create a subscription / membership on the Website using an email account. A User / Buyer / Customer may not create more than one membership with the same email address.
2.2. Age Restriction: To use the Services offered by the Service Provider / Seller and to open a Subscriber / Member / User Account, one must be at least 18 years of age / the legal age required to use online services in the country of residence, and have the legal capacity to enter into contracts. Those who do not meet these conditions may only benefit from the services offered by the Service Provider / Seller through their parents / legal guardians. If it is determined that a Subscriber / Member / User Account has been created by someone who does not meet these conditions, the Account will be terminated by us.
2.3. Prohibition on Account Transfer: A Subscriber / Member / User Account and profile may under no circumstances be transferred, sold, or made subject to any bargain to any third party.
2.4. Accuracy: The Subscriber / Member / User Account Holder is obliged to keep all personal data, including their email address, up to date. The User / Buyer / Customer accepts, declares, and undertakes that all information provided is accurate, complete, and not fraudulent, that it complies with the law, public morality, and the intellectual and industrial property rights, privacy rights, and personal rights of third parties, as well as the Personal Data Protection Law (KVKK) and related legislation; that it does not contain personal data of third parties; and that they are responsible for any damage that may arise from such information being false or inaccurate, and will compensate the Service Provider / Seller for any damages it may suffer in this regard.
In order for Products sold through the Website to be delivered on time, the User / Buyer / Customer must accurately and completely fill in their Subscription / Membership information.
Service Provider / Seller cannot be held responsible for notification and delivery issues, delays, and disruptions arising from inaccurate, erroneous, or outdated account information.
2.5 Account Security: The User / Buyer may not share the password assigned to them by the Service Provider / Seller with any other person or organisation; the right to use the password belongs exclusively to the User. The User / Buyer is solely responsible for any damage that may arise from this; the Service Provider / Seller bears no responsibility.
2.6 Account Closure: The User / Buyer may request deletion of their Subscriber / Member / User Account by sending an email request to our support team. Likewise, the User / Buyer may delete their own Account. The User / Buyer should be aware that in this case they may no longer be able to access the services offered by the Service Provider / Seller and the news, information, and other content related to those services.
Furthermore, the Service Provider / Seller reserves the right at any time and unilaterally to delete the User / Buyer's membership, and to delete files, documents, and information belonging to the User / Buyer when necessary. The User / Buyer accepts this right in advance. In such a case, the Service Provider / Seller bears no responsibility.
Article 3 – E-Commerce and Shop Terms
3.1. Intermediary Liability: The Service Provider / Seller may act as an intermediary for the sale of third-party products in the "Shop" section, in addition to its own products. In such cases, the responsibility for shipping, returns, and warranty lies with the relevant supplier. The User / Buyer is also subject to the "Distance Sales Agreement" for details regarding these products.
3.2. Payment System: The Service Provider / Seller may use third-party providers (İyzico, PayTR, etc.) for payment transactions. The User / Buyer is deemed to have accepted the policies of these organisations. The use of invalid or unauthorised payment methods is grounds for immediate suspension of membership.
3.3. Production Centre: The production centre is Turkey.
3.4. Customs and Taxes: As specified in the Terms of Use, Preliminary Information Form and Distance Sales Agreement.
Article 4 – Education, Digital Content, Licence
4.1. Limited Licence: A Subscriber / Member who registers for online training/activities is granted a personal, non-commercial, and non-transferable licence to view the content for personal use only. Content is "licensed", not "purchased".
4.2. Access Period: Unless otherwise stated, access to training content is limited to 1 year from the date of registration. The Service Provider / Seller reserves the right to disable access to such content at any time for copyright complaints or legal reasons.
4.3. Participation Certificate: Certificates issued are participation documents and do not substitute for official accreditation.
Article 5 – Legal Protection and Liability
5.1. Indemnification :
5.1.1. The User / Buyer [www.tantijewellery.com](https://www.tantijewellery.com) agrees from the outset to comply with and not to violate applicable legal provisions while using the website. Any and all damages suffered by the Service Provider / Seller due to false information or breach of contract by the User / Buyer shall be indemnified in full by the User / Buyer; all legal and criminal liabilities that may arise shall be borne entirely and exclusively by the User / Buyer.
5.1.2 Service Provider / Seller shall not be responsible for unauthorised access to User / Buyer data by third parties, or for any damage to the User / Buyer's software and data. 5.2. Personal Responsibility:
5.2.1. The User / Buyer is personally responsible for the opinions, thoughts and comments they declare or write on the site. Personal views are binding on their author. These views and opinions have no connection or relationship with the Service Provider / Seller. The Service Provider / Seller bears no responsibility for damages that third parties may suffer due to opinions and views expressed by the User / Buyer, nor for damages that the User / Buyer may suffer due to opinions and views expressed by third parties.
5.2.2. The User / Buyer may not use the Service Provider / Seller's [www.tantijewellery.com](https://www.tantijewellery.com) website and mobile applications in a manner that disturbs public order, violates public morality, harasses or annoys others, in a way that causes harm to the Service Provider / Seller or any other person or organisation, in any manner prohibited by the Terms of Use, for any purpose contrary to law, or in any way that infringes the intellectual and copyright rights of others.
The User / Buyer may also not engage in activities or transactions that prevent or hinder others from using the services (spam, virus, trojan horse, etc.).
The Service Provider / Seller shall be held harmless from all legal and criminal consequences arising from 5.2.1 and 5.2.2.

The copyright and/or other intellectual property rights relating to these are protected by applicable law. They may not be used, acquired, or modified without permission by the User / Buyer. The User / Buyer may not record, modify, edit, copy, sell, license, distribute, publish, adapt, reproduce, or re-use any product / content / service on the Service Provider / Seller's [www.tantijewellery.com](https://www.tantijewellery.com) website and mobile applications for any public or commercial purpose.
5.3. Evidence Agreement: The digital records belonging to the Service Provider / Seller shall constitute sole and conclusive evidence and shall constitute an evidence agreement pursuant to Article 193 of the Code of Civil Procedure (HMK) and other relevant provisions.
5.4. The Service Provider / Seller may use members' personal information in its work related to users' personal preferences and areas of interest.

The User / Buyer's information collection, use, and disclosure conditions are explained in detail and published in our Privacy & Personal Data Protection Policy and Cookie Policy, which are incorporated by reference into the Terms of Use.
5.5 The User / Buyer declares and accepts that they permit the Service Provider / Seller to present product and service promotions, advertisements, campaigns, benefits, surveys, and other customer satisfaction applications under current and/or future practices. The User / Buyer declares and accepts that they permit the collection, sharing, use, and archiving by the Service Provider / Seller of their personal and shopping information as well as shopping and/or consumer behaviour information that they have provided in the past and/or will provide in the future when subscribing/becoming a member and/or through other means, for the purposes stated above. Unless the User / Buyer notifies otherwise, they declare and accept that they permit the collection, sharing, use, and archiving of their data even after their membership ends. Unless the User / Buyer notifies otherwise, they declare and accept that they permit the Service Provider / Seller to contact them via internet, telephone, SMS, and other communication channels. The User / Buyer declares and accepts that they will not make any claims and will not hold the Service Provider / Seller responsible for any direct and/or indirect, material and/or moral, negative and/or positive damage of any kind they may suffer due to the collection, sharing, use, archiving, and access to the information mentioned above. If the User / Buyer wishes to change their data sharing preferences, they may submit this request to the Service Provider / Seller's customer service call centres.
5.6. The Service Provider may disclose the User / Buyer's personal information to relevant parties when required as a legal obligation; when there is a necessity to comply with legal requirements and legal proceedings served on the Service Provider / Seller; or in cases where it is in good faith deemed necessary to protect and defend the rights/property of the Service Provider / Seller / website.
5.6. The Service Provider / Seller has taken measures within available means to ensure that the website is free from viruses and similar malicious software. In addition, to ensure final security, the user must obtain their own virus protection system and take the necessary precautions. In this context, by accessing the Service Provider / Seller's website, the User / Buyer is deemed to have accepted that they are responsible for all errors that may occur in their own software and operating systems and for all direct or indirect consequences thereof.
5.8. The Service Provider / Seller reserves the right to modify or terminate the content of the site and any service provided to users, or to delete user information and data registered on the Service Provider / Seller's website.
5.9. By approving this Subscription (Membership) Agreement, the User / Buyer is deemed to have consented to receiving informational emails and informational SMS messages to their registered email address and the specified phone numbers.
5.10. A User / Buyer who violates one or more of the provisions set out in this agreement shall be personally liable in criminal and legal terms for such violation, and shall hold the Service Provider / Seller harmless from the legal and criminal consequences of such violations. In addition, if the matter is referred to the courts due to such violation, the Service Provider / Seller reserves the right to claim compensation from the User / Buyer for non-compliance with the Disclosure Texts (Privacy & Personal Data Protection Policy – Cookie Policy), Terms of Use, Preliminary Information Form and Distance Sales Agreement and the Subscription (Membership) Agreement.
Article 6 – Termination of Agreement
6.1 This agreement shall remain in force until the User's subscription / membership is cancelled by the User or by the Service Provider / Seller. The Service Provider / Seller may unilaterally terminate the agreement by cancelling the User / Buyer's subscription / membership in the event that the User / Buyer breaches any provision of the agreement.
Article 7 – Privacy and Data Transfer (KVKK/GDPR)
7.1. Due to the company's headquarters being in the USA, the User expressly consents to the cross-border transfer of data. The Service Provider / Seller reserves the right to record and use anonymously the User / Buyer's activity on the site for statistical purposes (trend analysis, etc.).
Article 8 – Jurisdiction and Entry into Force
8.1. The Parties agree that disputes arising from the application and interpretation of the Disclosure Texts (Privacy & Personal Data Protection Policy – Cookie Policy), Terms of Use, Preliminary Information Form and Distance Sales Agreement, Subscription (Membership) Agreement shall be submitted to the District/Provincial Consumer Arbitration Committees at the location of the Service Provider's registered address within the monetary limits set by legislation; and in cases exceeding those limits, to the Consumer Courts at the location of the Service Provider. 8.2. The Service Provider may amend, update, or revoke the conditions of the Disclosure Texts (Privacy & Personal Data Protection Policy – Cookie Policy), Terms of Use, Preliminary Information Form and Distance Sales Agreement, Subscription (Membership) Agreement at any time without prior notice or warning. Each amended, updated, or repealed provision shall take effect for all members on the date of publication. The User / Buyer is deemed to have accepted the updated terms by continuing to use the site.
8.3. The User / Buyer's completion of subscription / membership registration signifies that the User / Buyer has read and accepted all provisions of the Disclosure Texts (Privacy & Personal Data Protection Policy – Cookie Policy), Terms of Use, Preliminary Information Form and Distance Sales Agreement, Subscription (Membership) Agreement. This Agreement is concluded and mutually entered into force at the moment the User subscribes / becomes a member.
